Due to the Internet’s ever changing nature, BidOkee may need to update this Privacy Policy from time to time. If so, We will post its updated Privacy Policy on our Website and we may send Users an email. We do this to help keep You stay aware of what personally identifiable information we may collect and how we may use this information. If we make material changes to this policy, we will notify you here, by email, or by means of a notice on our home page.

Information Collection and Use

You can generally visit our Website without revealing any personally identifiable information about yourself, although We do log all visitors’ IP addresses. However, if you choose to open a User account we will ask for Your name and contact information including home or business address, email address, telephone number, and other information and financial information such as credit card numbers or Your e-wallet account information. We will also ask you to create a username and User account (“User Information”).

By creating a User account on BidOkee, You agree to receive emails from Us. Email preferences can be modified in your User account settings. We will only send you emails if You opt in to receive emails from Us. Our emails will contain a conspicuous unsubscribe link through which You will be able to modify your email subscription settings, including cancelling email subscriptions.

Privacy of Individuals Under 18

BidOkee respects the privacy interests of individual under age 18 and we encourage parents and guardians to take an active role in their children’s online activities and interests. This Website is not intended for individuals under the age of 18. We do not target Our Services or this Website to individuals under 18. BidOkee does not knowingly collect Personal Information from individuals under the age of 18. Please visit our Terms for terms regarding Website age restrictions.

Cookies

A cookie is a piece of data stored on the user’s hard drive containing information about the user. Cookies generally do not permit us to personally identify you. We use cookies to save user passwords so that Users do not have to re-enter the password manually every time they visit the Website. We do not use any third-party tracking cookies.

Aggregate Information

The Website may track the total number of visitors to our Website, the number of visitors to each page of our Website, browser type, and IP addresses, and we may analyze this data for trends and statistics in the aggregate, but such information will be maintained, used and disclosed in aggregate form only and it will not contain personally identifiable information. Currently, BidOkee does not share, sell, rent or trade your Personal Information with third parties other than as disclosed within this privacy policy.

We reserve the right to disclose your Personal Information and your communications on this Website as set out in this Privacy Policy and as required to do so by applicable law and when we believe that disclosure is necessary to protect our rights, to protect the rights of other users of the Website, and/or to comply with a judicial proceeding, court order, or legal process served on our Web site, or when we deem it appropriate or necessary to provide such information to law enforcement authorities. In particular, without limiting the generality of the foregoing, please note that:

  1. BidOkee may share with and among its affiliated companies any registration information, any information concerning potentially fraudulent activities on BidOkee.com, and any other information it may obtain or possess regarding any user of BidOkee.com, as far as is permitted by law;
  2. BidOkee reserves the right to report any activity conducted in connection with the Website or Service that it reasonably suspects violates any law or regulation to appropriate law enforcement officials, regulators, or other third parties;
  3. BidOkee may, as far as is permitted by law, access, collect, and disclose any information it considers necessary or appropriate, including, without limitation, user contact details, IP address and traffic information, usage history and posted content, in order to cooperate with court orders or to protect BidOkee’s systems and customers from fraudulent or illegal activity; and

You acknowledge that any protection of Your information described in the Privacy Policy or otherwise granted by law, including laws protecting Your information, may be superseded by the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (USA PATRIOT Act) in certain very unlikely circumstances relating to Users, transactions, auctions, or other actions located in the United States, and that BidOkee may be required to disclose information pursuant to the USA PATRIOT Act that could otherwise be protected by the Privacy Policy.

BidOkee does not disclose User Information except where:

  1. We have your consent;
  2. We provide such information to trusted businesses or persons for the sole purpose of processing information on Our behalf;
  3. We have reason to report to a credit-reporting agency pursuant to the Terms;
  4. We need to deliver a product or service that You have ordered; or
  5. We are complying with valid legal process.

We may transfer your Personal Information to a successor entity upon a merger, consolidation or other corporate reorganization in which We participate or to a purchaser of all or substantially all of BidOkee’s assets to which this Website or the Services relates.

We may share your Personal Information with any affiliated companies, entities, or organizations such as partners, joint ventures, and subsidiaries of BidOkee. This Privacy Policy and the Terms of Use shall bind such affiliated companies, entities and organizations.

Any content you share, submit, or post on the Website, including comments, may be disclosed publicly to other Users of BidOkee and will be subject to the Terms of Use.

Disclosure of Personal Information to Referral Network

BidOkee operates a four level referral system whereby Users may obtain Perks in exchange for referring other individuals to the Website.  You may receive Perks in the following circumstances:

(a) when you refer another individual to the Website (a “First Level Referral”);

(b) when a First Level Referral refers another individual to the Website (a “Second Level Referral”);

(c) when a Second Level Referral refers another individual to the Website (“a “Third Level Referral”)

(d) when Third Level Referral refers another individual to the Website (a “Fourth Level Referral”)

Collectively, all individuals referred to the Website as a First Level Referral, Second Level Referral, Third Level Referral or Fourth Level Referral in relation to a particular User constitute that User’s “Referral Network”.

In order to enhance the functionality of our referral system certain information regarding the members of a User’s Referral Network will be viewable to that User.  In particular, every User of the Website with an active Account may be able to view the following information in relation to members of their Referral Network:

(a) the User ID and/or name of the other User who referred the Referral Network member to the Website;

(b) any Perks gained by a User in exchange for referring a member to your Referral Network;

(c) all the contributions a particular member of your Referral Network has made to any crowdfunding campaigns through the Website, including the date of contribution and amount contributed.

Collectively the information in (a) through (c) above is referred to as the “Network Information.” By using the Website or Services or registering for an Account on the Website You consent to your Network Information becoming publicly available to other Users of the Website who are members of your Referral Network as further discussed above. No other Personal Information, such as User mailing addresses, email addresses or phone numbers will be publicly viewable in this manner unless you have first expressly opted into sharing this information.

From time to time We may contact Users generally or only specific Referral Networks with information and promotions relating to the Website, including offers to support other crowd funding campaigns on the Website. We may also allow Users to send messages directly to members of their Referral Networks, including messages promoting individual crowdfunding campaigns, through functionality provided by the Website. Additionally, Users may be able contact other Users within their Referral Network through functionality provided by the Website. By using the Website or Services or registering for an Account on the Website You agree to receive such communications from Us or members of your Referral Network.

We may, from time to time, modify the information that may be publicly viewable to a User regarding the members their Referral Network. If these modifications result in information additional to the Network Information becoming available, We will request the consent of all Users affected before making such information available, and will only make a User’s information available upon receiving that User’s prior consent.

Users may be able to restrict the Network Information that is publicly viewable to members of their Referral Network by adjusting privacy settings on the Website. In particular Users choose to share their Network Information with all Users of the Website, or restrict the information that is shareable to their Referral Network. However, Users will not be able to opt-out of having the Shared Information be viewable to a member of that User’s Referral Network.

Agents/Service Providers

From time to time we may use other third parties to send out emails on our behalf and a third party marketing provider to provide broadcast email services for us.  When you sign up to receive newsletters, marketing material or other communication from BidOkee, we will share your name and email address as necessary for the third party to provide that service. These third parties are prohibited from using your personally identifiable information for promotional purposes other than those described in this paragraph.

Any emails you received from BidOkee whether director or through third party services providers shall have an opt-out or unsubscribe option clearly displayed allowing the user to opt-out or unsubscribe from future emails from BidOkee.

Links to Third Party Websites

We may provide links to other Web sites or resources over which We do not have control (“External Websites”). Such links do not constitute an endorsement by Us of those External Websites. You acknowledge that We are providing these links to you only as a convenience, and You further agree that We are not responsible for the content of such External Websites. Your use of External Websites is subject to the Terms of Use and privacy policies located on the linked to External Websites.

Security

We may employ procedural and technological security measures that are reasonably designed to help protect Your Personal Information from loss, unauthorized access, disclosure, alteration or destruction. BidOkee may use industry-standard secure socket layer (SSL) and other security measures to help prevent unauthorized access to Your Personal Information.

Any information you offer in your profile will be recorded in our database. This information will not be disclosed to any third parties without your consent, except as set out in this Privacy Policy. BidOkee and its directors, officers, agents, employees, affiliated companies, contractors, and suppliers will not be held responsible for any hacking attempt that may lead to Your Personal Information being compromised or disclosed and by using the Website as further set out in our Terms of Use, you indemnify BidOkee against any and all damages resulting from the same.

Correcting/Updating Personal Information

BidOkee provides You with the ability to review, correct, and delete any Personal Information you have on record with Us. If you wish to review or correct Your Personal Information, You may access Your account online or You may contact Us at customerservice(at)bidokee.com

Account Termination

Users will be able to terminate their User account by using an account termination tool in their User settings. Personal information associated with the User account will remain on Our servers but will be rendered inactive and any publicly available information not related to a User account will cease to be viewable.

Upon termination of a User account, the content associated with that account will be rendered inactive but may remain publicly viewable and will not necessarily be deleted.
